1. Acceptance of Terms

By accessing and using Aawas Nepal ("the Platform", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, you must not access or use our services.

These terms apply to all visitors, users, property owners, buyers, renters, and others who access or use the service. By creating an account, listing a property, or browsing listings, you acknowledge that you have read, understood, and agree to be bound by these terms.

2. Description of Service

Aawas Nepal is an online platform that connects property owners with potential buyers and renters in Nepal. Our services include:

• Property listing and search functionality
• Owner verification and property moderation
• Secure communication between parties through admin-mediated channels
• Geospatial search with location-based filtering
• User account management and property tracking

We operate as an intermediary platform and do not directly buy, sell, or rent properties. All transactions occur directly between property owners and interested parties.

3. User Accounts and Registration

3.1 Account Creation

To access certain features of our platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Owner Verification

Property owners must undergo verification before listing properties. This includes providing valid identification documents and proof of ownership. We reserve the right to verify all documentation and reject listings that do not meet our verification standards.

4. Property Listings

4.1 Listing Requirements

All property listings must:

• Be accurate and truthful in all respects
• Include valid ownership documentation
• Comply with all applicable laws and regulations in Nepal
• Not violate any third-party rights
• Be submitted by the property owner or authorized representative

4.2 Listing Moderation

All listings are subject to administrative review and moderation before publication. We reserve the right to:

• Approve, reject, or request modifications to any listing
• Remove listings that violate these terms or applicable laws
• Suspend or terminate accounts of users who violate our policies
• Edit listing content for clarity or compliance purposes

4.3 Listing Fees

Basic property listings are currently provided free of charge. However, we reserve the right to introduce premium listing features or fees in the future with appropriate notice to users.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Bypassing Verification: Attempting to contact property owners directly using information obtained from our platform without going through our official inquiry system
• Data Scraping: Using automated tools or scripts to extract, copy, or harvest data from our platform
• False Information: Posting false, misleading, or fraudulent property information or user details
• Spam and Abuse: Sending unsolicited messages, spam, or engaging in any form of harassment
• Circumventing Security: Attempting to breach or circumvent any security measures on our platform
• Unauthorized Access: Accessing or attempting to access areas of the platform that you are not authorized to access
• Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble any aspect of our platform

Violations of these prohibitions may result in immediate account suspension or termination, legal action, and reporting to relevant authorities.

6. Intellectual Property

All content on the platform, including but not limited to text, graphics, logos, images, software, and the compilation thereof, is the property ofAawas Nepal or its content suppliers and protected by copyright and other intellectual property laws.

Property owners retain ownership of their property listings and images. By submitting content to our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with our services.

7. Payments and Transactions

Aawas Nepal does not handle payments between property owners and buyers/renters. All financial transactions occur directly between the parties involved.

Any service fees, booking advances, marketing packages, or other charges that may be offered in the future are invoiced separately and subject to:

• Applicable Nepali tax regulations
• Our payment terms as specified at the time of purchase
• Refund policies as outlined in the specific service agreement

All fees are non-refundable after services are rendered, unless otherwise specified in writing. We are not responsible for any disputes arising from transactions between users.

8. Limitation of Liability

Aawas Nepal acts as an intermediary platform and does not:

• Guarantee the accuracy, completeness, or quality of property listings
• Verify the legal status of properties beyond owner verification
• Warrant the condition, value, or availability of listed properties
• Assume responsibility for transactions between users
• Guarantee that users will find suitable properties or buyers

To the maximum extent permitted by law, Aawas Nepal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claims arising from or related to the use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred NPR, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Aawas Nepal, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:

• Your access to or use of our services
• Your violation of these Terms of Service
• Your violation of any law or regulation
• Your property listings or content you submit
• Your infringement of any rights of another party

10. Termination

We reserve the right to suspend or terminate your account and access to our services immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Engagement in fraudulent or illegal activities
• Repeated violation of our policies
• Extended periods of account inactivity
• Request by law enforcement or regulatory authorities

Upon termination, your right to use the service will immediately cease. All provisions of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Dispute Resolution

Any disputes arising from or relating to these Terms of Service or our services shall be resolved through:

1. Good Faith Negotiation: Parties shall first attempt to resolve disputes through good faith negotiation
2. Mediation: If negotiation fails, disputes shall be referred to mediation under the rules of the Nepal Mediation Council
3. Jurisdiction: Any legal action or proceeding arising from these terms shall be brought exclusively in the courts of Nepal, and you consent to the jurisdiction of such courts

12. Changes to Terms

We reserve the right to modify or replace these Terms of Service at any time at our sole discretion. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. Your continued use of the service after any such changes constitutes your acceptance of the new terms. If you do not agree to the new terms, you must stop using the service.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Nepal, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nepal.

Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. The headings in these terms are for convenience only and have no legal or contractual effect.
